TERMS AND CONDITIONS

These terms comprise the entire agreement between Louisa J Bridal Hire and you, the parties in relation to use of the services and create a binding legal contract between both parties. We recommend that you read these terms and conditions carefully. Louisa J Bridal Hire enters into a legally binding contract with the presumption of and reliance that you have read, understood and accept to be bound by these Terms and Conditions.

The services of Louisa J Bridal Hire are provided by confirmed appointment and can be requested online through the website or by phone. Use of the website to book an appointment is a request only, subject to Louisa J Bridal Hire accepting and confirming the appointment.  There is no fee charged for booking an appointment.

Damage or soiling of item/s caused by mistreatment or carelessness in store may lead to Louisa J Bridal Hire concluding the appointment and seeking payment from you to repair the damage or to have the item/s drycleaned. This is irrespective of whether the damage or soiling was caused by trying on the item/s or from browsing or handling our items. You may be held responsible to compensate for damage caused by zips where you did not seek or wait for assistance from a stylist.

Your intent to enter into a rental agreement is confirmed under these Terms and Conditions by you making payment of any amount and providing Louisa J Bridal Hire with all information requested on the client form.

Once entering a contract, or by completion of any process where an item/s is reserved for you, or by payment of deposit, you renounce any course of recovery of any monies paid to Louisa J Bridal Hire under any of these Terms and Conditions herein.

All bookings require a 50% non-refundable deposit. This confirms your agreement to the hiring of the products and the acceptance of these Terms and Conditions.

The remaining fee must be paid in full before the hired Item/s are released for pickup.

If you wish to cancel the rental of the item, you must provide 7 days’ notice prior to the pickup date and time. If less notice is received, you will be liable to pay the remaining rental fee (less deposit).

The hired item/s may be hired out to other customers before your scheduled hiring period. We will endeavour to maintain the hired item/s in a reasonably good condition suitable for hiring.

The booking is abandoned if you do not pick up the hired item/s during the hiring period, and our service to you is deemed to have completed.

You can change your booking to hire different item/s at least 2 weeks before the scheduled pick-up date by paying the difference in hiring fees for the new item/s (if applicable).

In the event that the hired item/s are unavailable on pick-up date due to unforeseeable circumstances (e.g. late return, damage, lost), we will do our best to make alternative arrangements for you, or refund to you the hiring fee deposit paid.

If you cancel the booking due to government COVID-19 restrictions (event cancellations or postponement; self-isolation), you must give us at least 1 week notice before the scheduled pick-up date. We will reschedule the booking or issue a store-credit for hiring to you equivalent to the value of the deposit paid. The credit will be valid for 6 months.

All hired item/s are to be returned to our store during our normal trading hours by the agreed return date. If the item is not returned on the return date, you will incur a late fee of $30 for each additional day you retain the item. If it is not returned 7 days after the agreed return date, you will be charged the full rental fee on top of the original rental fee that has already been paid.

If the hired item/s are returned with minor damage, irremovable staining, or alterations without our consent, you will be liable to pay the cost for the repair of the item/s.

We will clean the hired item/s after you have returned them. You are not required to clean the hired item/s.

The hired item/s always remain the property of Louisa J Bridal Hire. If the hired item/s get lost, stolen, damaged beyond repair, or not returned to us within 14 days of the scheduled return date, we reserve the right to recover the cost of the hired item/s up to the Recommended Retail Price of the hired item.

Louisa J Bridal Hire allows a cooling off period up until 5 pm, local time the day after placing an order, whereby an order can be cancelled without penalty. Louisa J Bridal Hire will refund any money paid in deposit

You authorise Louisa J Bridal Hire to charge any remaining balance for your hire to your nominated credit card, if a cancellation occurs within 7 days of agreed pick-up date or you do not collect items on agreed pick-up date.

Louisa J Bridal Hire reserves the right to refuse the item/s to leave the premises until the account is paid in full.

A valid current Australian driver’s license and a current Mastercard or Visa (Amex not accepted) in the name of the person who has signed or agreed to the Terms and Conditions needs to be presented at the time of deposit being paid.

The hirer, or person responsible for the hirer, warrants that the information supplied to Louisa J Bridal Hire is true and correct and that all identification provided is accurate and current.

Cancellation by you of the rental or failure to collect the item/s for any reason whatsoever, does not entitle you to a refund, a credit note, or the transfer of credit to another item/s or date, or to another person’s rental.

Should Louisa J Bridal Hire authorise the hire to be transferred to another date and be unable to supply the particular item hired, you will be offered another appointment without charge to select an alternative item.  Nothing in these Terms and Conditions entitles you to a refund after booking a dress in substitute for the item that Louisa J Bridal Hire could not supply.

Where the hire cost of the replacement item is less than the original item there will be no refund. Where the hire cost of the replacement item is greater than the original item, you will be required to pay the difference.

At your own risk you agree that these are rental item/s and therefore do not expect, nor is Louisa J Bridal Hire obliged to supply an item/s that is 100% perfect or in as brand-new condition, nor in the condition it was at the time of placing an order. It is at your own risk if there are any imperfections in the item/s, or if it is in a condition that is different to when you placed the order for the item/s to be reserved for you, or any time when you tried on the item/s.

It is your responsibility at the time of taking possession of the hired item/s to inspect the item/s for damage and check it is the item/s you ordered and required.  If the item/s supplied does not accord with your order or your expectations, or if it is alleged that they are defective or damaged, you must notify Louisa J Bridal Hire of any claim within 2 hours after receipt of the item/s in order to be eligible for compensation. Otherwise, no responsibility whatsoever shall be accepted for damage or supply of an incorrect item/s, or omission of item/s once it has left Louisa J Bridal Hire. Further, no compensation is due to you if the item/s has been worn since leaving the premises.

Further, unless you take a photo and report pre-existing damage to Louisa J Bridal Hire within 2 hours of you taking possession of the item/s, you will accept responsibility for any damage found after you have taken possession of the item/s. This is irrespective of Louisa J Bridal Hire inspecting and accepting the return of the item after your event, provided that Louisa J Bridal Hire offers you the opportunity to inspect alleged damage to an item/s after you have returned it.

You agree to treat the item/s with great care. Other than as described herein, you are responsible for all loss, destruction or damage to the item/s from the date of collection until the item/s are returned to Louisa J Bridal Hire. Louisa J Bridal Hire may at its sole discretion repair and/or clean any item/s and charge to your credit card for those repairs and/or cleaning.  Louisa J Bridal Hire is not obliged to provide care instructions for the item/s and your liability is not diminished by the failure of Louisa J Bridal Hire to inform you of the risks of certain fabrics.

When you report an item/s to be defective or damaged, Louisa J Bridal Hire may, at its sole discretion, request for the return of the item/s and provide you with a credit to the value of the hire fee, and/or charge back to your credit card the amount charged for hiring, provided always that the item/s have not been worn, used or soiled or otherwise further damaged. If the item/s has been worn or used it will be at the sole discretion of Louisa J Bridal Hire what value, if any, is refunded.

At its sole discretion, if Louisa J Bridal Hire considers the item/s to be beyond economical repair and/or cleaning, or not meeting quality standard for renting at the same price it had last been rented, you agree to compensate Louisa J Bridal Hire for any loss arising from future bookings for the item/s, confirmed by deposit, within the next 4 weeks from your event date.

If the item/s are lost or stolen whilst within your possession or control, you will be charged the Recommended Retail Price or the agreed replacement value of the item/s. You authorise Louisa J Bridal Hire to bill any additional penalty charges to your credit card without further express consent if the item/s are returned late, damaged, lost, soiled, stolen and/or not returned. You will also be liable to compensate Louisa J Bridal Hire for any loss associated with future bookings confirmed by deposit within the next 4 weeks from your event date.

If an item/s becomes unavailable due to theft, damage or late return by another person, or any other reason outside the immediate control of Louisa J Bridal Hire, you will be notified as soon as possible. In that event, you can either rent another item/s or have the debited funds remitted to your credit card.

You agree you are not entitled to take possession, nor is Louisa J Bridal Hire obliged to give You possession of the item/s if there are any omissions or incorrect information, absence of signatures on the order form or if there is money owing.

You agree to return the item/s to the premises of Louisa J Bridal Hire, on the agreed date.

Louisa J Bridal Hire is entitled to charge to your credit card a daily late fee and/or an additional hire fee if the item/s is not returned to the possession of Louisa J Bridal in accordance with these Terms and Conditions. You authorise Louisa J Bridal Hire to charge these amounts to your credit card without prior notice and without seeking further express permission from you.

You agree to permit sufficient time to wait for the item/s to be thoroughly examined for damage or potential additional costs for cleaning. Failure to wait for the item/s to be inspected automatically voids any right you have under these Terms and Conditions to claim the damage was on the item/s from the time it was collected.

Should any damage be overlooked whilst you were in the store to return the item, provided that you are notified within a reasonable time after leaving the store, you will be held liable for any damage to the dress that was not reported to Louisa J Bridal Hire within 2 hours of collecting the dress.

Notification of postponement within 7 days of the event date will incur a fee of $50 to transfer the item to the new date, payable at the time of collecting the item.

You agree to pay the late fee of $30 for each day that the item/s has not been returned after the time and date on which it is due to be returned. You authorise Louisa J Bridal Hire to charge your credit card for the fees payable.

If Louisa J Bridal Hire incurs a loss that would not have occurred other than for late return, you authorise Louisa J Bridal Hire to charge your nominated credit card without prior notice and without seeking further express consent, for an item/s not being available for the date it has been reserved by another person.

You acknowledge and accept full responsibility for the care of the item/s and agree to compensate Louisa J Bridal Hire for the replacement of the item/s if the item/s are not returned (whether due to loss, theft or any other reason) or if the item/s sustain any damage during the period of hire, whether such damage occurred while it was in your possession or not.  The onus is on you to notify Louisa J Bridal Hire in accordance with the terms to avoid being held responsible for pre-existing damage.

You agree to pay any fee incurred or billed to Louisa J Bridal Hire for the repair, and/or cleaning as the result of damage, soiling, staining, or any other cause that occurred after leaving the boutique for your use.

Louisa J Bridal Hire may engage a debt collection agency and any costs associated with recovery of money owed under these Terms and Conditions will also be claimed from you

Louisa J Bridal Hire may also take the matter to the Small Claims Tribunal, whereby the matter will be heard by the Perth Magistrates Court. Any judgement against you may be reported to credit rating agencies and which may affect your personal credit rating.

You acknowledge and agree that you are renting an item/s for a limited time and that ownership of the item/s at all times remains with Louisa J Bridal Hire.

Louisa J Bridal Hire has the right to have and use at its discretion copies of images of hired item/s displayed on social media.
